Why is having a Will important?

A Will is a powerful and incredibly important document that allows you to dictate how your estate and personal possessions are distributed to your loved ones after you pass away. Delaying the writing of a Will is not uncommon, many people do not want to think about death, but it is crucial to consider the peace you’ll experience, knowing that your loved ones are protected and your wishes are clearly documented, thus avoiding any unnecessary distress for your family during an already challenging time. Rest assured, we will meticulously handle every detail, safeguarding your loved ones and your estate.

One of the most frequent queries we get is from people who are in step family structures. They want their spouse/partner to be provided for, but are deeply concerned about also leaving an inheritance for their children. They’ve read or heard about the horror stories of ‘sideways disinheritance’, where children have lost out on inheriting when their parent passes away, and the estate is passed to the surviving spouse’s family instead. This is an area of estate planning we are specialists in, and can draft an estate planning solution that meets the ‘modern family’ dynamic.

We can also discuss the advantages of Trusts and how they optimise planning, ensuring a swift and tax-efficient transfer of your property, money, and assets to your loved ones.

It is also vital if you have children under the age of 18 to ensure you have appointed Guardians in your Will, making sure that if the worst were to happen they will be looked after by the people who you choose. If you do not appoint Guardians then the courts will decide who raises your children, and they may not appoint the people you would have preferred.

Our Services

Wills

After discussing your individual situation and wishes we will advise you of all your options and provide expertly and professionally drafted documents, explained in plain English, and give clear instructions on how to sign them to ensure they are legally binding.

Lasting Powers of Attorney

Having Lasting Powers of Attorney is just as important as having a Will, if not more. If you lose the capacity to deal with your own affairs, without the official documentation, your loved ones cannot take over for you without a lengthy & costly process of applying through the court.

Lifetime Trusts

There are many benefits to using Trusts. They can be used to save Inheritance Tax, protect your assets in the event your beneficiaries encounter financial hardship, and reduce or eliminate the need for probate, potentially saving thousands of pounds.

Inheritance Tax Planning

Estate Planning or Inheritance Tax Planning sounds as though it may be reserved only for the very wealthy…not so! This is especially due to the increase in house prices over the last few years. Without any planning, Inheritance Tax could mean that your family receive far less than you had hoped after you pass away.

Secure Document Storage

You can store your Will at home – but you risk it being lost or stolen. We can offer all of our clients secure document storage which will include supplying certificates to your executors so that, come the day, they know where to go to get your Will without having to search for your ‘safe place’.

Estate Administration & Probate

Some clients choose to undertake the estate administration themselves but others prefer to appoint a specialist firm to do the hard work for them. We offer access to professional services that can reduce the burden of administering the estate at an already difficult time.
